Standing Up Against Unreasonable Searches Or Seizures

While it is generally advisable to cooperate with the police during the entirety of your traffic stop, I will review every aspect of the officer’s conduct for proper procedures. Specifically, the police are generally required to have a valid reason for the initial traffic stop such as erratic driving that raises a reasonable suspicion of a crime in progress or about to occur. Although it is lawful for a police officer to ask for your driver’s license and vehicle registration, there must be reasonable suspicion before conducting a field sobriety test.

I may even suggest a legal defense that you might not otherwise have considered. For example, even “scientific” evidence such as Breathalyzer results can be fallible and open to challenges. A Breathalyzer must be periodically calibrated, and local police may have procedures requiring its proper administration. Medicines or other substances close to a device may also result in false results from breath or blood testing.
